ESIGN Disclosure and Consent
You can choose to receive important communications about your National Bank account(s) electronically instead of in paper form. Communications we may provide to you electronically include:
- Periodic statements and other notifications on Checking accounts
- Periodic statements and other notifications on Savings accounts
- Periodic statements and other notifications on Loan accounts
If you choose to receive these communications electronically, and we have not yet developed the means for electronic delivery of that communication, we will continue providing that communication in paper until available electronically. If you consent to electronic delivery of communications, you may at anytime withdraw your consent to receive them electronically by contacting us as described below.
The following disclosures are required by the federal Electronic Signatures in Global and National Commerce Act (“ESIGN’). Your consent to the terms of the disclosures is required for enrollment in electronic notices.
As used in this Disclosure, “Account” means your checking, savings, money market account, or loan you have with us. “Communication” means any periodic statements and other information in connection with selected Accounts. “Internet Banking” means National Bank Internet Banking and any other online product or service offered through our website in which you have enrolled that is not otherwise governed by an electronic disclosure and consent. “We,” “us,” and “our” means the National Bank entity where your Account is held, and “you” and “your” means the individual(s) or entity using Internet Banking.
By selecting the "Accept" button below, you consent to the following:
1. Scope of Communications to Be Provided in Electronic Form
You agree that we may provide you with any Communications that we may choose to make available in electronic format, to the extent allowed by law, and that we may discontinue sending paper Communications to you. Electronic Communications include, but are not limited to:
- all periodic statements in connection with the eligible Accounts that you have selected.
- all legal or regulatory notices, disclosures, cancelled checks, and other information that would be contained in or accompany your periodic statement, including information we are required by law or regulation to provide to you in writing, such as pricing information and privacy notices
- any other information about your eligible Accounts, including all notices or disclosures about a change in the terms of your eligible Accounts.
- any periodic notices in connection with the eligible Account(s) that you have selected and that are available in Electronic Form
You may view eligible Accounts by clicking on the Accounts tab in Internet Banking.
2. Method of Providing Communications to You in Electronic Form
We may deliver the Communications to you by any of the following methods: (a) by sending a notice to an email address you have provided us and making the information available to you through Internet Banking; or (b) by sending the information to an email address you have provided to us; (c) to the extent permissible by law, by access to a web site that we will generally designate in advance for such purpose; or (d) any other electronic means we have mutually agreed upon.
Delivery of electronic Communications by any of these methods will be considered “in writing” and you intend that the electronic Communications have the same legal effect as written and signed paper communications. You agree to promptly notify us of any change in your contact information, such as your email address or mobile phone number. You can update your contact information through Internet Banking.
3. How to Withdraw Consent
You may withdraw your consent to receive electronic Communications by contacting us at 540-951-6234 or 800-552-4123, emailing us at customerhelp@nbbank.com, or by contacting your local branch. Any withdrawal of your consent to receive electronic Communications will be effective only after we have a reasonable period of time to process your withdrawal. We may treat an invalid email address as a withdrawal of your consent to receive electronic Communications. Withdrawal of consent by one owner of an account will be effective for all owners.
4. How to Update your Records
It is your responsibility to provide us with true, accurate and complete email address, contact and other information related to the Disclosure and your Account(s), and to maintain and update promptly any changes in this information. You can update information (such as your e-mail address) through Internet Banking, by calling us at either 540-951-6234 or 800-552-4123, emailing us at customerhelp@nbbank.com, or by contacting your local branch.
Any notification of change of email address you provide to us must be received by us at least thirty (30) business days before the scheduled delivery of the electronic communications.
5. Requesting Paper Copies
We will not send you a paper copy of any Communication which is available electronically from us, unless you request it, or we otherwise deem it appropriate to do so. You can obtain a paper copy of an electronic Communication by printing it yourself or by calling National Bank Customer Assistance at 540-951-6234 or 800-552-4123, emailing us at customerhelp@nbbank.com, or by contacting your local branch. We may charge you a reasonable service charge or copying charge, of which we have provided you prior notice, for the delivery of paper copies of any Communication provided to you electronically pursuant to this authorization. We may exercise our right to deliver paper copies of disclosures, notices, and other records, rather than provide them electronically. All paper documents will be sent to the primary address we have on file for you at the time of delivery.
6. Hardware and Software Requirements
The minimum hardware and software requirements to access and retain the electronic Communications are:
- A personal computer or other device with operating system and telecommunications connections to the Internet capable of receiving, accessing, displaying, and either printing or storing electronic Communications;
- an e-mail account with an Internet service provider and e-mail software;
- a supported browser, which is the latest version of Microsoft Edge and current versions of Firefox, Safari, and Chrome.
- sufficient electronic storage capacity on your computer’s hard drive or other data storage unit;
- Adobe Acrobat, Reader, or Professional versions 10.0 and higher
7. Communications in Writing
All Communications in either electronic or paper format from us to you will be considered “in writing”. You should print or download for your records a copy of this Disclosure and any other Communication that is important to you.
8. Termination / Changes
National Bank may change, suspend, or eliminate all or any part of this delivery service upon notice to you. National Bank also has the right to rescind this Agreement at any time and for any reason without advance notice.
9. System unavailability
Access to Internet Banking may be unavailable at certain times for maintenance or major unforeseen events that may cause system outages. National Bank will make all reasonable efforts to ensure the availability of Internet Banking. However, National Bank is in no way liable for the unavailability of electronic communications or any consequential damages that may result.
10. Your Responsibilities
It is your responsibility to view your statements, notices, and disclosures at your earliest convenience. These documents contain important and legally binding information and/or disclosures. You are responsible for promptly notifying National Bank if any documents you receive are incomplete, unreadable, or inaccessible. You are responsible for keeping your Username and Password confidential and for ensuring that you have logged out when your session is complete to prevent unauthorized access. It is your responsibility to contact us if you know or suspect unauthorized use of your Username and Password. National Bank will not, for any reason, ask for your logon credentials and/or password. You understand that you have a duty to exercise reasonable promptness in examining the eStatement which includes your cancelled checks for unauthorized signatures, alterations, forgery, or posting errors. You are solely responsible for the selection, installation, maintenance, and operation of your personal computer, software, and/or mobile device.
NOTE:
Please do not include sensitive information in emails to us because we cannot assure the security of the information sent to us via such e-mail, and it is possible that such information could be intercepted during transmission.
